Capability
Claim Preparation & Rebuttal
Assemble or answer a claim package: strategy note, records, analysis exhibits, and a narrative the commercial and legal team can stand behind.
C02 — The problem
The technical problem
Delay analysis, TIA, and EOT produce technical pieces. Someone still has to assemble a claim or rebuttal the other party, the engineer, or counsel can use — sequence of issues, exhibits, and a narrative that does not outrun the records.
Claim Preparation & Rebuttal is that assembly assignment. It is not a duplicate of TIA and not a promise of recovery. Prolongation figures, if required, come from a quantum assignment or existing cost records.
C03 — Engagement
When this capability is needed
-
01
Submission deadline
A claim is due and the pieces are not yet a pack.
-
02
Incoming claim
A rebuttal must meet the other party’s analysis on evidence.
-
03
Negotiation
A brief is needed that states strength, exposure, and record quality.
-
04
Records crisis
The file may not support the narrative already circulating.
C04 — Scope / method
How the work is approached
Strategy, records review, assembly of claim or rebuttal, and a negotiation brief. Specialist analysis (TIA, delay, quantum) may be included or referenced from companion assignments.
-
01
Frame the issues
What will be claimed or answered, in what order.
-
02
Assess the records
What exists, what is missing, what that does to each issue.
-
03
Assemble exhibits
Programmes, notices, cost, and site facts with consistent references.
-
04
Write the pack
Narrative that counsel can legally settle.
-
05
Prepare the brief
A usable summary for negotiation without rewriting findings.
C05 — Outputs
Typical deliverables
| Output | What it contains |
|---|---|
| Claims strategy note | Issues, sequence, and record position. |
| Records gap assessment | What the file cannot currently support. |
| Claim or rebuttal pack | Narrative and exhibits. |
| Negotiation brief | Strength, exposure, and record quality. |
C06 — Decision value
What this work is used to decide
Whether to submit, concede issues, or contest, and how strong the contemporaneous file is. No recovery is promised.
C08 — Project environments
Relevant project environments
C09 — Who we support
Who commonly needs this capability
C10 — Boundaries
Important distinctions
This is technical and commercial support. Legal strategy and representation remain with appointed counsel.
